IMCA publishes new contracts

Published on 29 November 2012

The International Marine Contractors Association (IMCA) has published the updated Contract for the Provision of ROV, Support Vessel and Associated Work (based on BIMCO Supplytime 89) – IMCA R 013 Rev, 1 and a new second publication based on BIMCO Supplytime 2005 (IMCA R 017), which is used by many IMCA members. Both set out relevant additional clauses and variations relevant to ROV operations.

Each IMCA member is free to enter into whatever contracts it deems to be in its own interests. In publishing this contract, IMCA is aiming to raise awareness on contracting matters among IMCA members and their clients, facilitating dialogue and providing a generic, familiar document which can be built on as appropriate for each contract.

“Where existing publications are used as daily worktools, it makes sound sense to incorporate these, with relevant revisions, into the IMCA contracting ‘library’,” explains IMCA’s Chief Executive, Hugh Williams.”All such documents are free to download for members and non-members alike.”

The two contracts contain:

Clauses:

  • Definitions and interpretation
  • Charter of the vessel
  • The work
  • Entire agreement

Schedules:

  • BIMCO ‘Supplytime 89’ Uniform Time Charter Party for Offshore Service Vessels or BIMCO ‘Supplytime 2005’ Time Charter Party for Offshore Service Vessels
  • Variations and additions to the relevant BIMCO terms
  • Work
  • Insurance
  • Company and contractor representatives
  • Breakdown

“Both contracts are important additions to a range of guides, templates and discussion documents aimed at raising awareness on contracting issues, promoting discussion and providing tools that may be useful for IMCA’s contractor members, their clients and sub-contractors,” adds Hugh Williams.”Each is published as an aide to clients and contractors alongside their in-house standard contracts and other industry publications.”

The documents can be downloaded free of charge by members and non-members alike from the IMCA website at www.imca-int.com. Printed copies of each of them can be purchased from the association at £5.00 for members and £10.00 for non-members via the website, or from publications@imca-int.com or from IMCA at 52 Grosvenor Gardens, London SW1W 0AU, UK.
